Pro Bono Team Successfully Resolves Prisoner Rights Litigation
Wachtell Lipton is pleased to announce that a team led by Jonathan M. Moses, Justin L. Brooke, Jessica L. Layden, Cesar E. Garcia, and former associates Wilfred T. Beaye and Getzel Berger, recently obtained the successful resolution of long-running prisoner rights litigation on behalf of a certified class of all prisoners incarcerated at Green Haven Correctional Facility, a maximum security state prison in Dutchess County, New York. The case brought claims for violations of the United States Constitution and the Americans with Disabilities Act in connection with the provision of medical care to incarcerated individuals at Green Haven, including the provision of care and treatment relating to individuals with physical disabilities and chronic illnesses.
The relief takes the form of a Modified Consent Order, which provides comprehensive improvements to nearly all aspects of health care administration at Green Haven, in addition to compliance and monitoring requirements, and which was reached following extensive negotiations between the parties. Following a fairness hearing, on February 1, the United States District Court for the Southern District of New York permanently approved the Modified Consent Order, finding it fair, reasonable, and adequate.
After having been substituted as counsel in 2021 following a remand of the case from the Second Circuit, the Wachtell Lipton team, together with co-counsel the Law Office of Amy Jane Agnew, P.C., conducted extensive document, deposition, and expert discovery and briefing in preparation for an evidentiary hearing, and then engaged in comprehensive discussions to arrive at the Modified Consent Order, successfully resolving the litigation.
